  • This course is pending 11.4 Continuing Legal Education Credits. New Jersey Redevelopment Authority is an approved CLE Provider through the Supreme Court of New Jersey Board on Continuing Legal Education.

This two-day course on the redevelopment planning process will provide a broader understanding of the crucial issues, steps and challenges associated with the New Jersey’s Local Redevelopment and Housing Law (LRHL).  The workshop includes an in-depth review of the LRHL, an analysis of the redevelopment planning process designations, discussion on how to engage the community in the redevelopment planning process, review and examination of the redevelopment plan in relations to current legal issues and challenges, review of the mandatory and optional provisions of the redeveloper’s agreement, and discussions on some of the recent legal and public policy issues on redevelopment such as eminent domain, environmental liability and relocation.

 

This course will also cover:                                    
  • Legal criteria used to make a determination between an area in need of redevelopment or in need of rehabilitation
  • Interaction of redevelopment and other required or beneficial governmental action
  • What experts, advisors, and support should be brought into the process and when
  • Technical requirements of the redevelopment planning process
  • How to prepare for public hearings and deal with oppositions
  • Community engagement in the redevelopment process
  • Eminent domain and the possibility of condemnation
  • Redevelopment plans and agreements
  • Financing, grants, and tax issues in redevelopment projects
  • Environmental due diligence  


Faculty Spotlight


Anthony F. Della Pelle graduated from Franklin & Marshall College with Bachelor of Arts Degree in Economics and English, and received his Juris Doctor from Seton Hall University School of Law.  A member of the bar since 1987, he is admitted to practice before state and federal courts in New Jersey and New York, and is board certified as a Civil Trial Attorney by the Supreme Court of New Jersey, Board on Trial Attorney Certification.  His practice concentrates on condemnation, eminent domain and redevelopment matters. He has represented property owners throughout New Jersey, as well as a variety of government agencies including Allamuchy, Bernards, Boonton, Cresskill, Fair Lawn, Harding, High Bridge and Montclair, in condemnation, real estate tax appeal and land use matters.

Mr. Della Pelle has been appointed by the Superior Court of New Jersey as a receiver and legal advisor in real estate valuation matters, and holds the highest ranking, “AV”, from the Martindale Hubbell Law Directory. He is a member of the American Bar Association and its Condemnation Committee; the Morris County Bar Association where he chairs the Condemnation Committee; the New Jersey State Bar Association; the New Jersey State Builders Association and its Redevelopment Committee; the Community Builders Association; and the Urban Land Institute. He is also a Trustee of the Franklin & Marshall College Alumni Association.

Mr. Della Pelle has been selected to be listed in New Jersey Super Lawyers© as published in New Jersey Monthly Magazine, where he was recognized as one of Super Lawyers© 100 most highly rated attorneys in New Jersey.  He was also selected as one of New Jersey's top real estate attorneys by Real Estate New Jersey Magazine in 2009.
